THE FOLLOWING PROMOTION IS OPEN ONLY TO MALE U.S. CITIZENS WHO ARE 18
YEARS OF AGE OR OLDER AND WHO ARE LEGAL RESIDENTS OF ONE OF THE
FOLLOWING “PROMOTIONAL CITIES”: (1) BOSTON, MASSACHUSETTS, (2) DETROIT,
MICHIGAN, (3) SAN DIEGO, CALIFORNIA, OR (4) SEATTLE, WASHINGTON. VOID
OUTSIDE THE PROMOTIONAL CITIES AND WHEREVER PROHIBITED. THIS PROMOTION
WILL BE CONSTRUED AND EVALUATED ACCORDING TO U.S. LAW. PROMOTION BEGINS
AT 12:00:00 A.M EASTERN DAYLIGHT TIME (“EDT”) ON JUNE 2, 2008, AND ENDS
AT 11:59:59 PM EDT ON JULY 20, 2008 (THE "PROMOTION PERIOD"). DO NOT
ENTER THIS PROMOTION IF YOU DO NOT CURRENTLY RESIDE IN ONE OF THE
PROMOTIONAL CITITES.
1. HOW TO PLAY: To participate in the Promotion, visit
www.ACEformen.com, complete the online survey entry form with all
required information, and submit as instructed on-screen during the
Promotion Period. All entries must be received by 11:59:59 P.M. EDT on
July 20, 2008. Limit one entry per person and per email address.
Additional entries that are received from the same person or email
address will be disqualified. Entries become the property of ACE, a
division of Newell Rubbermaid, Inc. (“Sponsor”) and will not be
acknowledged or returned. Proof of submission is not proof of receipt by
Sponsor. Entries made through any robotic, automatic, mechanical,
programmed or similar entry duplication methods are ineligible and will
be disqualified. Sponsor reserves the right to disqualify any individual
and all entries using such methods. In the event of a dispute as to the
identity of an entry, such entry will be deemed made by the person named
on the entry form. Any lost, late, misdirected or incomplete entries, or
entries not in conformance with these Official Rules, will be
disqualified.
2. ELIGIBILITY: Promotion is only open to male U.S. citizens who are 18
years of age or older at the time of entry and who are legal residents
of one of the following Promotional Cities at the time of entry and at
the time the prize is awarded: (1) Boston, Massachusetts, (2) Detroit,
Michigan, (3) San Diego, California or (4) Seattle, Washington.
Employees of Sponsor and its parent company, affiliates, subsidiaries,
advertising and promotion agencies, Promotion judges, and members of
each of their immediate families (defined as spouses, parents, children
and siblings, whether such family members are biological, adoptive, step
or in-law) and those living in the same household of such employees are
not eligible to enter or win.
3. WINNER SELECTION: Entries from each Promotional City will be reviewed
by representatives of Sponsor and/or the Celebrity Athlete associated
with that city*, who will select two entrants to receive the “Celebrity
Athlete Meet & Greet Experience” (as described in Rule 4, below) for
that Promotional City. Selection will be based on how memorable and
interesting the survey question answers are, and the desire of the
applicable Celebrity Athlete to meet the entrant. Judging shall take
place on or about July 28, 2008 from all eligible entries received
during the Promotion Period. Odds of being selected to participate in
the Celebrity Athlete Meet & Greet Experience depend on the number and
quality of eligible entries received for each Promotional City. In
addition, on or about July 28, 2008 five (5) entries from among all
entries received will be selected in a random drawing to win a First
Place prize (as described in Rule 4, below). Odds of winning a First
Place prize depend on the number of all eligible entries received.
* Celebrity Athletes are as follows:
a. For Boston, Massachusetts: Glen Davis, professional basketball player
b. For Detroit, Michigan: Justin Verlander, professional baseball player
c. For San Diego, California: Kris Dielman, professional football player
d. For Seattle, Washington: Daryl Tapp, professional football player
4. PRIZES/APPROXIMATE RETAIL VALUES:
a. Celebrity Athlete Meet & Greet Experience: Two (2) entrants from each
Promotional City will be awarded the Celebrity Athlete Meet & Greet
Experience which will consist of a meeting for the winner and one (1)
guest with the Celebrity Athlete associated with the Promotional City
for up to fifteen (15) minutes at a time and place (in the Promotional
City) designated by Sponsor based on the Celebrity Athlete’s
availability. Each winner of the Celebrity Athlete Meet & Greet
Experience, and such winner’s guest, will receive one (1) jersey and one
ball (of the type associated with the Celebrity Athlete) which the
Celebrity Athlete will autograph at the Meet & Greet. Winners and guests
are not allowed to bring additional items for autographs. Sponsor is not
responsible for any expenses associated with winners’ and guests’ travel
to or attendance at the Meet & Greet destination. Approximate retail
value (“ARV”): $280.00.
b. First Place Prize: Five (5) entrants total will be awarded the

5. PRIZE NOTIFICATION/WINNER VERIFICATION: The potential winners will be
notified by phone, email or mail and will be required to execute and
return an affidavit of eligibility, liability release and, except where
prohibited by law, a publicity release within seven (7) days of date
printed on prize notification, or prize will be forfeited and an
alternate winner selected from the remaining eligible entries received,
time permitting. Guests of the winners of the Celebrity Athlete Meet &
Greet Experiences may not be minors unless winner is the parent or legal
guardian of the guest. Guests of winners must sign and return a
liability/publicity release within time frame specified by Sponsor. If
guest is an eligible minor, in accordance with these rules, then winner
must execute such documents on said guest’s behalf.
Prizes are non-transferable except as provided herein or at the
discretion of the Sponsor. No prize substitutions or cash redemptions,
except Sponsor reserves the right to substitute a prize of equal or
greater value if for any reason an advertised prize cannot be awarded as
intended in these rules; and potential winners agree to such
substitution as a condition of entry in this Promotion. Winner is
responsible for payment of any income taxes on prizes under applicable
federal, state and local laws. Sponsor advises potential winners to seek
independent tax counsel prior to accepting a prize.
By accepting the prize, each winner consents to the use of his/her name,
photograph, quote and/or likeness for advertising/publicity purposes in
commerce and in any and all media worldwide without limitation or
additional compensation, except where prohibited by law.
If any prize notification letter or prize is returned as undeliverable,
or if appropriate affidavits and releases are not received within the
prescribed period, the corresponding prize will be forfeited and awarded
to an alternate winner, chosen at random from the remaining eligible
entries received, provided that adequate time remains to do so before
the event date. All prizes properly claimed will be awarded. Judges’
decisions are final in all matters relating to this Promotion.
6. MISCELLANEOUS: By entering and/or accepting a prize, each entrant
and/or winner (a) agrees to release Sponsor and its parent company,
affiliates, subsidiaries, divisions, advertising and promotion agencies,
and all of their respective employees, directors, officers,
shareholders, agents, attorneys, successors or assigns (collectively
“Releasees”), from any and all liability, loss or damage of any kind
incurred with respect to participation in this Promotion, the awarding,
receipt, possession, and/or use or misuse of any prize, or participation
in prize-related activities (including but not limited to travel related
thereto); and (b) consents to the use of his/her name, likeness, quotes
and/or identity for advertising and publicity purposes by Releasees,
with no additional compensation, as
permitted by law. Releasees are not responsible for and are hereby
released from liability with respect to: (i) electronic
transmissions/entries that are lost, late, stolen, incomplete,
illegible, damaged, garbled, destroyed, misdirected, or not received by
the Sponsor or its agents for any reason, (ii) any problems or technical
malfunctions, errors, omissions, interruptions, deletions, defects,
delays in operation or transmission, communication failures or human
error that may occur in the transmission, receipt or processing of
entries, or for destruction of or unauthorized access to, or alteration
of, entries, (iii) failed or unavailable hardware, network, software or
telephone, cable or satellite transmissions, damage to entrants’ or any
person’s computer and/or its contents, or causes beyond Sponsor’s
reasonable control that jeopardize the administration, security,
fairness, integrity or proper conduct of this Promotion or (iv) any
entries submitted in a manner that is not expressly allowed under these
Official Rules. All incomplete or non-conforming entries will be
disqualified. Releasees are further not responsible for and are hereby
released from liability with respect to incorrect or inaccurate entry
information
whether caused by Internet users or by any of the equipment or
programming associated with or utilized in the Promotion or by any
technical or human error which may occur in the transmission, receipt or
processing of the entries. If for any reason this Promotion is not
capable of running as planned, or if this Promotion or any Web site
associated therewith (or any portion thereof) becomes corrupted or does
not allow the proper playing of the Promotion and processing of entries
per these Official Rules, or if infection by computer virus, bugs,
tampering, unauthorized intervention, actions by entrants, fraud,
technical failures, or any other causes, in Sponsor’s sole opinion,
corrupt or affect the administration, security, fairness, integrity, or
proper conduct of this Promotion, Sponsor reserves the right, at its
sole discretion, to disqualify any individual implicated in such action,
and/or to cancel, terminate, modify or suspend this Promotion. In the
event this Promotion is cancelled, Sponsor reserves the right to conduct
a random drawing to award the prizes from among all eligible,
non-suspect, entries received prior to the time of the action or event
warranting such cancellation.
7. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE
THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL
AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES
THE RIGHT TO DISQUALIFY ANY SUCH PERSON AND SEEK DAMAGES FROM HIM/HER TO
THE FULLEST EXTENT PERMITTED BY LAW.
8. WINNERS LIST: For the names of the winners, mail a self-addressed,
stamped envelope to: ACE “Meet Your Hometown Athlete” Winner Request,
1775 Woodstock Road, Suite 200, Roswell, GA 30075. All requests must be
received by July 21, 2008.
9. PRIVACY POLICY: The personal information collected from each entrant
in the course of the Promotion will be used by the Sponsor for the
purposes of administration of the Promotion and as otherwise permitted
in accordance with Sponsor’s Privacy Policy.
